By visiting and using this website, you are entering into a contract in which you agree to be bound by these Terms and Conditions.

The Bumblebee Bindery reserves the right to alter these Terms and Conditions at any time without prior notice. As such, it is advisable to review them regularly. By visiting and using this website after any such alterations have been made, you are entering into a contract in which you agree to be bound by these updated Terms and Conditions.

These Terms and Conditions are valid from 30/07/2017, and are governed by the laws of Scotland, the United Kingdom, and the European Union. You agree to submit to the exclusive jurisdiction of the Scottish courts in the event of any dispute.

1. Visiting and Using the “The Bumblebee Bindery” website

Acceptable Use

This website may only be used in accordance with these Terms and Conditions. This includes complying with all applicable laws, regulations and codes of practice within Scotland, the UK, or any other jurisdiction from which the site is accessed.

Accuracy of Information

The Bumblebee Bindery aims to produce and publish information and content that is accurate and up-to-date. However, as a sole trader, the owner is fallible and cannot guarantee accuracy at all times.

Users who choose to use and/or act upon information from this website do so at their own risk.

Tutorials published on The Bumblebee Bindery website are not a substitute for professional education or training. Visitors who choose to employ any of the techniques, tools, and/or equipment depicted on this website are advised that they do so at their own risk. To the extent allowed by law, The Bumblebee Bindery and/or its owner/operator will not be liable for any injuries, damages, or losses that result from such activities.

Product dimensions are approximate to the nearest millimetre, and all other specifications are described as accurately as is reasonably possible. Product colours are presented as accurately as possible but may vary from colours shown on your monitor due to differences in colour rendering across equipment.

Items for sale on The Bumblebee Bindery website are handmade, and may contain subtle variances unique to each item. These variances should not be considered to be flaws unless specifically described as such in the product description. Items that do contain flaws will be tagged as ‘Seconds’, and appropriately reduced in price. The Bumblebee Bindery will also endeavour to provide photographs of any such flaws via the product image gallery.

Custom orders and commissions may be subject to changes, as is the nature of developing a product in collaboration.

Links To and From The Site

The Bumblebee Bindery website may contain links to other websites. These are known as external links. Inclusion of these links to other sites does not constitute endorsement of them. Whilst The Bumblebee Bindery will make reasonable efforts to curate external links appropriately, it cannot be held responsible for any content accessed by following them. Websites reached via external links are subject to their own terms and conditions which may differ from those specified here. Your use and access of such sites is entirely at your own risk. Availability of linked pages cannot be guaranteed.

Virus Protection And Security

The Bumblebee Bindery aims to safeguard the website from viruses and/or malicious code as well as is reasonably possible. This includes:

  • Use of a firewall, to limit malicious attempts to log in to the site or access its code and/or data.
  • Use of an external gateway provider (PayPal) for all payments and financial transactions. This means that The Bumblebee Bindery does not have access to your financial information (e.g. credit card details).
  • Coming soon: use of SSL encryption, to ensure that any information you enter on The Bumblebee Bindery website remains private.
  • Regular scanning for known vulnerabilities and security risks
  • Regular scanning for malware

However, it is always wise for users to run an anti virus program on all material downloaded from the internet. The Bumblebee Bindery cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material from this website.

Limitation of Liability

To the extent that it is lawfully able to do so, in no event will The Bumblebee Bindery be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages arising out of access to, or the use/inability to use this website or any information contained in it or arising out of the services it provides. This includes loss of profit and the like, whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise, even is advised of the possibility of such damages. To the maximum extent permitted by law, The Bumblebee Bindery’s liability to you in connection with its products under these terms and conditions shall not exceed the value of the goods. Privacy Policy and Cookies

This privacy policy sets out how The Bumblebee Bindery uses and protects any information that you provide whilst using this website. The Bumblebee Bindery is committed to ensuring that your privacy is protected.

During registration, checkout, and/or communication with The Bumblebee Bindery, the following information may be collected and/or stored:

  • your contact information, including email address/es.

The Bumblebee Bindery requires this information for the following reasons:

  • To communicate with you about your order
  • To fulfill your order
  • For legal reasons (e.g. payment of taxes)

The Bumblebee Bindery will not sell, distribute or lease your personal information to third parties without your permission unless required by law to do so.

Security

The Bumblebee Bindery is committed to ensuring that your information is secure. In order to reduce the risk of unauthorised access or disclosure, suitable physical, electronic and managerial procedures to safeguard and secure the information it collects online have been put in place . These are outlined above. In the event of a data breach at The Bumblebee Bindery or its server/s, The Bumblebee Bindery will:

  • Notify by email, within 7 business days: any users and/or customers who may be affected
  • Notify its hosting partners, and work with them to re-secure the site as soon as possible
  • Notify any relevant authorities

The Bumblebee Bindery would like to reiterate that it does not store or process payment information (e.g. Credit card details) onsite. This is carried out externally, via PayPal’s secure systems.

A cookie is a small file which asks permission to be placed on your computer’s hard drive. Cookies allow The Bumblebee Bindery to analyse data about web page traffic and improve the website accordingly.

This information is only ever used for statistical analysis purposes and then the data is removed from the system. I am keen to engage with followers on these sites, and will try to reply to messages and comments wherever it is reasonable and appropriate to do so. However, as a sole trader, I cannot guarantee the same response rates and times as you may be used to from larger companies and corporations. Interaction Policy (Comments and Discussion):

On this site, and on The Bumblebee Bindery’s social media profiles, there are various opportunities for interaction with The Bumblebee Bindery, and with other individuals and groups. These include being able to make public posts (e.g. comments), and private posts (e.g. direct messages). Generally speaking, comments are welcomed and encouraged within these areas. However, for the protection of my users and myself, The Bumblebee Bindery will endeavour to remove and/or report any contributions that are not in line with either The Bumblebee Bindery’s Interaction Policy, or the terms and conditions of the website that they are posted to. Repeat and/or persistent offenders may be blocked from the relevant profile/s at the sole discretion of The Bumblebee Bindery. Additionally, The Bumblebee Bindery reserves the right to edit or delete any submitted comments and/or content without notice.

The Bumblebee Bindery strives to promote a culture of inclusion and respect both on this site, and at all of its various social media and other online profiles. As such, the following House Rules are in place:

  • Spam, and/or material that is deemed by The Bumblebee Bindery to be solely promotional in nature is not permitted. You may include links to relevant content, but comments should be relevant to the post topic wherever reasonably possible.

  • The Bumblebee Bindery is operated by a sole trader, and as such is not infallible. I will endeavour to listen to criticisms, and to learn from my mistakes.

2. Products, Orders, and Commissions

Purchases

Establishing a contract

On placing an order via the “The Bumblebee Bindery” website, you will receive an e-mail confirming receipt and the details of your order.

The order you place represents an offer to purchase a product which is accepted by The Bumblebee Bindery when it processes the payment and dispatches the order to you. Any products within the same order which are not charged for or dispatched are not included within that same contract.

The Bumblebee Bindery reserves the right to refuse an order at any time. In the event of any refusal or other issue with you order, you will be contacted via the email address you provided.

Availability and Pricing

Because The Bumblebee Bindery also makes use of other sales outlets, all orders are subject to availability. In the unlikely event that an item you purchased is no longer available, The Bumblebee Bindery will contact you to discuss options. Depending on the item and materials used, these options may include refund, exchange, or replication of the item you chose.

All prices shown are correct at the time of publication. Prices are shown in GBP (£).

Shipping

Processing time

The time needed to prepare an order for shipping varies depending on the items chosen, and how you choose to pay. For details, see individual items. Stated processing times are estimates, and are not guaranteed. However, The Bumblebee Bindery will attempt to meet these expected times as often as is reasonably possible.

Estimated shipping times

Europe: 3-5 business days
Everywhere Else: 5-7 business days

The Bumblebee Bindery aims to meet these shipping estimates as often as is reasonably possible, but it can’t guarantee them. Actual delivery time will depend on the shipping method you choose, and may be affected by factors outwith The Bumblebee Bindery’s control.

Shipping Costs

The costs of shipping items varies. You will receive a quote during checkout, before you decide whether or not to go ahead with the order.

Customs and import taxes

Buyers are responsible for any customs and import taxes that may apply. The Bumblebee Bindery is not responsible for delays due to customs.

Please also note that The Bumblebee Bindery will not comply with any requests to misidentify orders for the purpose of avoiding customs and import taxes. This constitutes fraud, and will not be tolerated. A common example of this would be asking for your order to be marked as a gift.

Payment options

PayPal

PayPal is a service that enables you to pay for your order securely, without revealing your financial details. You do not need a PayPal account, and The Bumblebee Bindery does not have access to your payment information. This payment option allows you to pay using Visa, MasterCard, Maestro, American Express, or your PayPal balance.

Bank Transfer

If you select this option at checkout, you will be emailed with further instructions. Orders will not be shipped until the funds are cleared.

Cheque or Postal Order

Please send your cheque or postal order to Miss Jayne M. Kennedy, 10 Hawthornbank Place, Edinburgh EH6 4HG. Cheques should be made payable to Miss Jayne M. Kennedy. Orders will not be shipped until the funds are cleared.

Cash in person

If you are in Edinburgh and you’d like to pay for, and collect, your order in person, you can select this option during checkout. The Bumblebee Bindery will contact you to arrange a meeting.

Discounts and Coupons

From time to time, The Bumblebee Bindery may issue discounts and coupon codes. These are categorised as following:

Single Use Coupon Codes:

These are issued on an individual basis, entirely at the discretion of The Bumblebee Bindery. For example, a coupon may be offered in lieu of a refund in certain circumstances. Single Use Coupon Codes are:

  • valid for items that are already reduced in price
  • not valid for more than one use
  • not transferable (you may not share this type of coupon code with other people)
  • not valid in combination with other coupon codes.
  • may be subject to further terms and conditions to be specified at time of issue
Special Discount Coupon Codes:

These are issued on an individual basis, entirely at the discretion of The Bumblebee Bindery. For example, under certain circumstances The Bumblebee Bindery may offer discounts to specific charities, or to individuals with a low income. Special Discounts are:

  • valid for items that are already reduced in price
  • sometimes valid for more than one use (this will be specified at time of issue)
  • not transferable (you may not share this type of coupon code with other people)
  • sometimes valid in combination with other coupon codes (this will be specified at time of issue)
  • may be subject to further terms and conditions to be specified at time of issue
Publicly Available Coupon Codes:

These are coupon codes that are publicly displayed on The Bumblebee Bindery website, or via its social media profiles. Publicly Available Coupon Codes are:

  • not valid for items that are already reduced in price unless otherwise specified
  • not valid for more than one use
  • transferable (you may share this type of coupon code with other people)
  • not valid in combination with other coupon codes.
  • may be subject to further terms and conditions to be specified at time of issue

All usage of coupon codes issued by The Bumblebee Bindery is tracked. Coupon codes will not be honoured if they are found to have been used outwith the terms and conditions stated either here or at the time of issue.

Cancellations, Returns and exchanges

The Bumblebee Bindery is happy to accept cancellations, returns, and exchanges on most of its items. If you have any problems with your order, please do not hesitate to get in touch.

Conditions of Cancellation:

For most items, you may contact The Bumblebee Bindery before you receive notice that your item has shipped. This usually means within 1-2 business days.

Cancellations are not accepted for personalised items.

Conditions of Return and/or Exchange:

Contact The Bumblebee Bindery within 14 days of delivery. Items must be shipped back to The Bumblebee Bindery within 21 days of delivery. Buyers are responsible for return shipping costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.

Exceptions:

Because of the nature of these items, unless they arrive damaged or defective, I can’t accept returns for:

  • Items that are personalised
  • Items that are tagged as Seconds
  • Items that are tagged as On Sale

Personalisation, Custom Orders, and Commissions

In addition to its Ready-to-Ship items, The Bumblebee Bindery offers the following types of bookbinding service:

Custom Orders and Personalisation

Custom Orders are standard items available in the shop, which are made to order according to your selection/s from a number of options. Such options might include choice of materials, and add-on options, e.g. internal pockets, or additional bookmarks. Processing times for these items may vary depending on your choice of options.

For some of these items, you may choose to personalise your order with initials, names, or other messages. These personalised items cannot be cancelled, returned, or refunded once ordered unless they arrive damaged or defective.

Commissions

Commissions are considered freelance work, and will be priced accordingly. As part of our initial interactions, The Bumblebee Bindery will work with you to establish a brief, an estimated processing time for your order, and an initial quote. Please be aware that any proposed changes to the brief may incur additional charges. Quoted prices will not include shipping, as an estimate for this cannot be determined until the final weight and dimensions of the product/s are known.

The Bumblebee Bindery reserves the right to refuse any commission requests without notice or explanation. The following types of requests will be automatically refused:

  • Reproduction of material that is copyrighted by a party other than The Bumblebee Bindery or the customer requesting the commission. Genuine collaborative works may be considered.
  • Creation or reproduction of material that is abusive, threatening, pornographic, false, misleading, libellous or otherwise disallowed by the laws of Scotland, the UK, any other jurisdiction from which the site is accessed .
  • Use of materials and/or creation of products that would be refused carriage by the Royal Mail or other couriers used by The Bumblebee Bindery.

Work on commissions will not begin until the client has paid a non-refundable deposit to The Bumblebee Bindery. This will usually be between 25% and 50% of the commission’s estimated final price. The final piece/s will not be shipped until the remaining balance has been paid in full.

Additional Information

The majority of The Bumblebee Bindery’s products are not suitable for young children. Any user purchasing items from The Bumblebee Bindery for use or ownership by children does so entirely at their own risk.

To the extent that it is lawfully able to do so, in no event will The Bumblebee Bindery be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages arising out of the ownership or use/inability to use any of its products.
